These terms and conditions apply to all freight and delivery services provided by Pilbara Freight (ABN 56 968 051 106), based in Karratha, Western Australia ("the Company", "we", "us", "our").
Pilbara Freight provides light freight, hotshot delivery, and remote area delivery services across the Pilbara and Kimberley regions of Western Australia. Services are provided using a light commercial vehicle (ute) with optional trailer configurations.
Our maximum payload capacity is 2,500kg (with tandem trailer). Loads exceeding this capacity cannot be accepted.
All quotes are provided exclusive of GST unless otherwise stated. GST of 10% applies to all services. Quotes are valid for 48 hours from the time of issue unless otherwise specified.
Pricing is calculated based on one-way distance (loaded kilometres), service type (standard or hotshot), and vehicle configuration required.
A minimum charge of $250 + GST applies to all deliveries.
A booking is confirmed once the customer accepts a quote through our online booking system or via email confirmation. Confirmed bookings are binding and subject to the cancellation policy outlined below.
For new customers, payment is required within 7 days of invoice date. For established account customers, payment terms of 14 or 30 days may be arranged by agreement.
Invoices are issued via Xero and can be paid by bank transfer or other methods as specified on the invoice. Late payments may incur interest at 2% per month on the outstanding balance.
Standard deliveries: Cancellations made more than 24 hours before the scheduled pickup time incur no charge. Cancellations within 24 hours of pickup are subject to a 50% cancellation fee.
Hotshot deliveries: Cancellations made more than 2 hours before the scheduled pickup time incur no charge. Cancellations within 2 hours of pickup are subject to a 75% cancellation fee.
Pilbara Freight carries comprehensive motor vehicle insurance and public liability insurance. However, our liability for loss or damage to goods in transit is limited to $1,000 per consignment unless additional transit insurance is arranged by the customer prior to dispatch.
We are not liable for delays caused by road closures, weather events, mechanical breakdowns, or other circumstances beyond our reasonable control.
Customers are responsible for ensuring goods are adequately packaged for transport. We reserve the right to refuse carriage of goods that are inadequately packaged or that may pose a safety risk.
We do not carry:
Customers must declare the nature of all goods at the time of booking. Failure to disclose restricted items may result in immediate termination of the delivery and forfeiture of all fees paid.
Estimated delivery times are provided in good faith based on normal driving conditions. Delivery times are estimates only and are not guaranteed. Factors including road conditions, weather, traffic, and fatigue management requirements may affect actual delivery times.
The driver is required to comply with Western Australian fatigue management laws at all times. This may result in rest stops that extend delivery times.
Pilbara Freight does not provide forklift services or any loading/unloading equipment. It is the sole responsibility of each location — both pickup and delivery — to arrange and manage the loading and unloading of all freight.
The customer must ensure that appropriate equipment (forklift, crane, manual labour, etc.) and personnel are available at both the pickup and delivery locations to load and unload goods from the vehicle. Pilbara Freight accepts no liability for delays, damage, or additional costs arising from inadequate loading or unloading arrangements at either location.
If loading or unloading cannot be completed due to a lack of equipment or personnel at the location, a waiting fee of $50 per 30 minutes will apply, and the delivery may be rescheduled at the customer's expense.
The customer must ensure that someone is available at both the pickup and delivery locations at the agreed times. If no one is available, a waiting fee of $50 per 30 minutes may apply after a 15-minute grace period.
The customer must provide accurate weight estimates for all freight. If the actual weight significantly exceeds the estimated weight and requires a different vehicle configuration, the price will be adjusted accordingly.
We collect and handle personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988.
Any disputes arising from these terms will be governed by the laws of Western Australia. Parties agree to attempt resolution through direct negotiation before pursuing formal legal proceedings.
Pilbara Freight reserves the right to amend these terms and conditions at any time. Updated terms will be published on our website. Continued use of our services after changes are published constitutes acceptance of the amended terms.
